Article 1 – Definitions
1.1. In these general terms and conditions, the following terms have the following meanings:

CryptoGold: the user of these terms.

Consumer: a natural person not acting in a professional or commercial capacity who enters into an agreement with CryptoGold.

Contract: the agreement between CryptoGold and the consumer.

Products offered by CryptoGold, such as precious metals, are subject to price fluctuations in the financial market that cannot be influenced by CryptoGold. Therefore, the right of withdrawal does not apply under Dutch Civil Code Article 6:230p. Orders cannot be canceled or returned once placed.

Article 2 – Applicability
2.1. These terms apply to all offers, orders, agreements, and services provided by CryptoGold, unless agreed otherwise in writing.
2.2. Any terms set by the consumer that conflict with these are only valid if explicitly accepted by CryptoGold in writing.

Article 3 – Offer
3.1. All offers are non-binding and may be withdrawn or changed.
3.2. Offers are valid while stocks last.
3.3. Pricing errors or inaccuracies do not bind CryptoGold.
3.4. Photos are for illustration and may differ from actual products.

Article 4 – Agreement
4.1. The agreement is formed when CryptoGold accepts the consumer’s order.
4.2. CryptoGold may refuse orders without stating reasons.
4.3. The agreement can be confirmed via email or invoice.

Article 5 – Prices
5.1. All prices are in euros and include VAT unless stated otherwise.
5.2. Additional costs such as delivery fees will be listed during checkout.
5.3. Prices may change due to market fluctuations.

Article 6 – Payment
6.1. Payments can be made using accepted payment methods offered by CryptoGold.
6.2. For cryptocurrency payments:

Payment must be completed within the stated timeframe.

Late or incorrect payments may result in delays or price changes.

Refunds are based on the euro value of the original transaction. No compensation is given for exchange rate fluctuations.

6.3. For credit card payments, the amount is reserved upon ordering and charged once the order is dispatched.
6.4. Orders are processed only after full payment is received.

Article 7 – Delivery
7.1. Delivery times are estimates and not guaranteed unless explicitly stated.
7.2. Delays do not entitle the consumer to compensation or contract termination.
7.3. Orders are shipped once full payment is received.
7.4. If an item is no longer available, CryptoGold will offer an alternative or a refund.

Article 8 – Retention of Title
8.1. Ownership of products remains with CryptoGold until payment is made in full.
8.2. Until then, the consumer may not resell, pledge, or transfer the goods.

Article 9 – Risk and Transport
9.1. Risk transfers to the consumer upon delivery.
9.2. Insured shipments remain at CryptoGold’s risk until the consumer signs for receipt.
9.3. The consumer must report transport damage immediately upon receipt.

Article 10 – Force Majeure
10.1. CryptoGold is not liable for delays or non-performance due to force majeure events (e.g., strikes, wars, natural disasters, supply chain disruptions).

Article 11 – Right of Withdrawal
11.1. There is no right of withdrawal for precious metal purchases due to price volatility.
11.2. Other items may be returned within 14 days if unused and in original condition, but only with prior approval.

Article 12 – Warranty
12.1. CryptoGold guarantees that products conform to the agreement and meet standard expectations.
12.2. No warranty applies to wear and tear, misuse, or damage caused by improper handling.

Article 13 – Complaints
13.1. Complaints must be submitted within 3 business days after receiving the order.
13.2. CryptoGold will respond to complaints within 14 days.

Article 14 – Liability
14.1. CryptoGold is not liable for indirect damages, including loss of profits or data.
14.2. Direct liability is limited to the amount invoiced for the relevant product.

Article 15 – Personal Data
15.1. CryptoGold respects the consumer’s privacy and processes data in accordance with privacy laws.
15.2. Data is used only for processing orders and maintaining the business relationship.

Article 16 – Security
16.1. CryptoGold uses appropriate technical and organizational measures to protect data and secure transactions.

Article 17 – Communication
17.1. CryptoGold is not liable for misunderstandings or delays caused by failures in communication, unless due to intent or gross negligence.

Article 18 – Intellectual Property
18.1. All content provided by CryptoGold (texts, images, logos) is protected by intellectual property laws.
18.2. Use of this content without permission is prohibited.

Article 19 – Cancellation and Return Policy
19.1. Orders for precious metals are final and cannot be canceled.
19.2. Non-metal goods may only be returned with prior written approval, unopened and unused.
19.3. Shipping costs for returns are at the consumer’s expense unless agreed otherwise.

Article 20 – Fraud Prevention
20.1. CryptoGold reserves the right to cancel orders if fraud or abuse is suspected.
20.2. In such cases, law enforcement may be informed.

Article 21 – Account and Identity Verification
21.1. CryptoGold may request identity verification for large orders or suspicious activity.
21.2. Failure to comply may result in cancellation or freezing of the order.

Article 22 – Resale Restrictions
22.1. Purchases are intended for personal use only.
22.2. Reselling without written permission is not allowed.

Article 23 – Communication Channels
23.1. All communication must be through approved CryptoGold channels such as email or customer support.
23.2. CryptoGold will never ask for passwords or sensitive info via unofficial means.

Article 24 – Product Descriptions
24.1. CryptoGold makes every effort to provide accurate product descriptions.
24.2. In case of discrepancies, the actual product specifications prevail.

Article 25 – Reviews and User Content
25.1. Consumers may post reviews, but CryptoGold reserves the right to remove content that is false, offensive, or violates the law.

Article 26 – Governing Law and Jurisdiction
26.1. All agreements are governed by Dutch law.
26.2. Disputes are submitted to the competent court in the Netherlands, unless mandatory law dictates otherwise.

Article 27 – Final Provisions
27.1. If any part of these terms is found invalid, the remainder stays in effect.
27.2. CryptoGold may amend these terms at any time. The latest version always applies to new orders.
